SOMMA - Terms of Service

1. Acceptance of Terms

By downloading, installing, or using SOMMA, you agree to these Terms. If you do not agree, do not use the App.

2. Description of Service

SOMMA is a nutrition and fitness tracking application that allows you to:

• Log food, exercise, water intake, and weight
• Analyze meals via AI-powered photo and text recognition
• Track macronutrients, micronutrients, and daily goals
• View progress statistics, streaks, and trends
• Set personalized reminders

3. Account Registration

You must create an account with a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. Subscriptions & Payments

• SOMMA offers a free tier and premium subscription plans (monthly and yearly).
• Subscriptions are billed through the Apple App Store or Google Play Store.
• Payment processing, renewals, and cancellations are governed by the respective platform's terms.
• You may cancel your subscription at any time through your device's subscription settings. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds directly; refund requests must be made through Apple or Google per their policies.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or tamper with the App
• Interfere with the App's infrastructure or other users' access
• Create multiple accounts for fraudulent purposes
• Submit false, misleading, or harmful content

6. Health Disclaimer

SOMMA is not a medical device and does not provide medical advice. Nutritional estimates generated by AI and third-party databases are approximations and may not be accurate. The App is intended for general wellness and informational purposes only.

• Do not rely on SOMMA as a substitute for professional medical advice, diagnosis, or treatment.
• Always consult a qualified healthcare provider before making dietary or fitness changes, especially if you have a medical condition.
• We are not responsible for health outcomes resulting from use of the App.

7. Intellectual Property

All content, design, code, trademarks, and intellectual property in the App are owned by TrueSmartTech. You may not reproduce, distribute, or create derivative works without our written consent.

8. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" and "as available" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the App ceases, and we will delete your data in accordance with our Privacy Policy.

10. Governing Law

These Terms are governed by the laws of Italy. Any disputes shall be resolved in the courts of Italy.

11. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes through the App. Continued use after changes constitutes acceptance.
